General terms and conditions of sale

This is a translation provided for information. In the event of any discrepancy, the French version of these terms prevails.

Preamble

The website cmaballe.com is operated by ALTITUDE INK, a single-member limited liability company (SARL) with a share capital of €3,000, registered with the Nanterre Trade and Companies Register under number 493 334 692, VAT number FR10493334692, whose registered office is at 45 route de la Reine, 92100 Boulogne-Billancourt, France (email: contact@cmaballe.com, telephone: +33 1 46 05 82 03).

The website and all related rights are the property of ALTITUDE INK. Any full or partial reproduction requires its authorisation. Hypertext links to the website are permitted without specific request.

Acceptance of the terms

These general terms of sale govern the contractual relationship between ALTITUDE INK and its customers. The customer acknowledges having read them when placing the order and accepts them without reservation. They prevail over any other terms, unless otherwise agreed in advance, expressly and in writing.

Products

2.1. Product photographs are as accurate as possible but are not contractually binding; slight differences in colour or appearance may occur.

2.2. For customisable products, a customer who wishes to reproduce a design (for example a photo or a logo) declares that they hold all legal rights to it. ALTITUDE INK cannot be held liable if the author of a design, their heirs or beneficiaries, or collecting societies claim compensation; in that case, only the customer is liable. ALTITUDE INK reserves the right to refuse any customisation that is unlawful or offensive.

Orders

Automatic recording systems constitute proof of the nature, content and date of the order. ALTITUDE INK confirms the order to the customer by email, at the address provided; the sale is concluded upon this confirmation. ALTITUDE INK reserves the right to cancel any order from a customer with whom there is a dispute concerning payment of a previous order. The information entered by the customer when ordering is binding: if the recipient's details are incorrect, ALTITUDE INK cannot be held responsible for being unable to deliver.

Prices

Prices are shown in euros, including all taxes (French VAT included). Delivery costs are not included in product prices: they are shown to the customer before the order is confirmed. The total amount shown on the order confirmation (products, customisation and delivery) is the final price.

For deliveries outside the European Union, customs duties, import taxes and any charges levied by the destination country are payable by the customer.

Payment

The price is payable in full at the time of ordering. Accepted payment methods are:

• bank card (CB, Visa, Mastercard…), via our secure payment provider Stripe;
• PayPal.

Card details are entered and processed directly on the secure servers of Stripe or PayPal: ALTITUDE INK never has access to them. The order is only confirmed once the payment provider has approved the payment; if payment is refused, the order is automatically cancelled and the customer is informed by email.

Payments by cheque, bank transfer or cash are not accepted for orders placed on the website.

Production and delivery

Customised products are made to order: allow a few days of production before dispatch. Unless otherwise stated, delivery takes place no later than 30 days after the order is confirmed.

Parcels are shipped by La Poste: Colissimo with tracking, to your home (with or without signature) or to a pick-up point in mainland France, and Colissimo International for other destinations. Free collection from our shop at 45 route de la Reine, Boulogne-Billancourt, is also available. Transit times are those announced by La Poste (generally 48 hours in mainland France after dispatch).

The risk of loss or damage passes to the customer when they take physical possession of the products, in accordance with article L216-4 of the French Consumer Code. We recommend that you check your parcel on receipt and, if an item is missing or damaged, record your reservations with the carrier and let us know promptly at contact@cmaballe.com.

If the customer wishes to use two delivery addresses, two separate orders must be placed, each with its own delivery costs. Unforeseeable and unavoidable events such as war, riots, fire, strikes, accidents or supply shortages are considered force majeure and suspend the obligation to deliver.

Right of withdrawal

Customised products cannot be returned, exchanged or refunded. In accordance with article L221-28 of the French Consumer Code, the right of withdrawal does not apply to goods made to the customer's specifications or clearly personalised: customised stamps and prints, marked clothing and accessories, gift sets once the design has been chosen, etc. Customisation includes adding personal text and/or images, and also using designs offered by ALTITUDE INK. By ordering a customised product, the customer acknowledges that they waive their right of withdrawal for that product.

For non-customised products only (for example ink refills or gift boxes sold on their own), you have 15 days from receipt of your order to exercise your right of withdrawal, without giving any reason. To do so, inform us of your decision by email at contact@cmaballe.com, then return the item(s), complete and in good condition, to the following address:

Return costs are payable by the customer. ALTITUDE INK refunds all sums paid, including the original delivery costs (based on standard delivery), within 14 days of being informed of the withdrawal; the refund may be withheld until the returned items have been received. It is made using the payment method used for the order.

Legal guarantees

All products benefit from the legal guarantee of conformity (articles L217-3 et seq. of the French Consumer Code) and the guarantee against hidden defects (articles 1641 et seq. of the French Civil Code).

Under the legal guarantee of conformity, the customer has two years from delivery of the product to take action; they may request repair or replacement of the product or, failing that, a price reduction or cancellation of the sale. Under the guarantee against hidden defects, they may request cancellation of the sale or a price reduction, within two years of discovering the defect.

Liability

ALTITUDE INK cannot be held liable for damage resulting from improper use of the products, nor for minor errors or omissions that may remain despite all the care taken in presenting the products.

Personal data

The information collected when ordering is necessary to process and deliver the order; it is intended for ALTITUDE INK and its service providers (payment, transport). In accordance with the General Data Protection Regulation (GDPR), you have the right to access, rectify, erase and object to the processing of your data, which you can exercise by email at contact@cmaballe.com. Disputes

In the event of a difficulty, the customer should first contact ALTITUDE INK (contact@cmaballe.com) to seek an amicable solution. All complaints are carefully considered.

In accordance with the French Consumer Code, after contacting ALTITUDE INK and in the absence of a satisfactory answer, consumers may use a consumer mediation procedure free of charge with: CM2C, 49 rue de Ponthieu, 75008 Paris – tél. 01 89 47 00 14 – www.cm2c.net/declarer-un-litige.php – litiges@cm2c.net.

These terms are governed by French law. Failing an amicable solution, the dispute will be brought before the competent court under ordinary rules; for business customers, the Commercial Court of Nanterre has sole jurisdiction.
