Preamble
The site is the property of the company C MA BALLE in its entirety, as well as all related rights. Any reproduction, complete or partial, is systematically subjected to the authorization of the owners. However, hypertext links to the site are authorised without specific request.
Acceptance of conditions
The customer acknowledges having read, at the time of placing the order, the special conditions of sale set out on this screen and expressly declares accepting them without reservation. The present general conditions of sale govern the contractual relations between C MA BALLE and its customer, both parties accepting them without reserve. These general conditions of sale will prevail over all other conditions appearing in any other document, except prior, express and written exemption.
Products
2.1. The photographs illustrating the products are not part of the contractual field. If errors are introduced there, in no case, the responsibility of C MA BALLE could be committed. Most of the products offered to its customers by C MA BALLE are available in our warehouse.
2.2. For the customizable products, the customer who wishes to reproduce a design (for example a photo or a logo), declares to hold all the legal rights relating to it. C MA BALLE cannot be held responsible in the event that the author of a design, or his heirs, successors, or collecting societies, agents of the author or his heirs or successors, should claim compensation. In this case, only the responsibility of the customer of C MA BALLE would be engaged.
Ordering
The automatic recording systems are considered as proof of the nature, content and date of the order. C MA BALLE confirms the acceptance of its order to the customer at the email address that the latter will have communicated. The sale will be concluded only after the confirmation of the order. C MA BALLE reserves the right to cancel any order of a customer with whom would exist a litigation relating to the payment of a former order. The information given by the buyer when placing an order is binding on the buyer: in the event of an error in the recipient's details, the seller cannot be held responsible for the impossibility of delivering the product.
Delivery
AAfter confirmation of the order, C MA BALLE undertakes to deliver within D+1 (working days) to its carrier, all the references ordered in stock by the purchaser, with a maximum delivery time of 96 working hours.
This carrier undertakes to deliver the order to the buyer's address provided by CmaBalle. In the case of a transport in system known as of against-refunding, the customer commits himself to pay to the carrier or his representative the totality of the sum indicated at the time of the confirmation of order.
In addition, for deliveries outside metropolitan France, the customer agrees to pay all taxes due on the import of products, customs duty, value added tax, and all other taxes due under the laws of the country in which the order is received. C MA BALLE is released from any legal responsibility if the payment of the taxes was not carried out by the customer.
Depending on the products ordered, the delivery will be made by La Poste in colissimo with or without signature, in Lettre Max or Lettre Suivi for Metropolitan France. Any delays do not entitle the buyer to claim damages. Deliveries in EEC countries are made by La Poste in colissimo suivi Europe, for deliveries outside the EEC, deliveries are made by international postal services.
In the case of a technical product, the customer shall take particular care to check the correct operation of the appliance delivered and to read the instructions for use provided. In the event of apparent defects, the buyer has the right to return the goods under the conditions set out in this document.
War, riot, fire, strikes, accidents and the impossibility of being supplied are considered as cases of force majeure discharging the seller from his obligation to deliver. Goods always travel at the risk of the recipient. Always check your package on arrival. You have a period of 48 hours to make any reservations with the carrier in the event of shortage or damage.
For reasons of availability, an order can be delivered to the customer in several parts. In this case, the customer only pays for one delivery. If the customer wishes to have two deliveries, he/she must place two orders, with the associated delivery costs.
Retractation
You have 15 days (from receipt of the items) to make up your mind. In case of exchange or refund, return the new item(s) in its (their) original packaging, undamaged, accompanied by all possible accessories, instructions for use and documentation to the following address

In the event of exercising the right of withdrawal, C MA BALLE is required to reimburse the sums paid by the customer within a maximum of 2 days, without charge, with the exception of the cost of return.
Only products not specifically personalised by the customer are concerned by this article, in accordance with article L 221-28 of the French Consumer Code.
Personalisation means the addition of personal texts and/or images but also the use of motifs proposed by C MA BALLE.
Price
The price is expressed in euros. The price indicated on the product sheets does not include transport. The price indicated in the order confirmation is the final price, expressed all taxes included and including VAT for France and the EEC countries. This price includes the price of the products, the handling, packaging and conservation costs of the products, the transport and commissioning costs.
Payment
The price invoiced to the customer is the price indicated on the order confirmation sent by C MA BALLE.
The price of the products is payable in cash on the day of the effective order. Payment is made by credit card, check or bank transfer. For credit card payments, your payment is made directly on the bank's servers in a secure environment without passing through the shop's server. This guarantee is all the more important as your numbers are known only to our banking partner (PayPal). The order validated by the customer will only be considered effective when the bank payment centres concerned have given their agreement. In case of refusal of the said centres, the order will be automatically cancelled and the customer will be informed by e-mail.
For payments by cheque or bank transfer, the goods will only be dispatched after receipt of the payments and validation by the banking establishment. Furthermore, C MA BALLE reserves the right to refuse any order from a customer with whom there is a dispute.
Litigation
This contract is subject to French law. C MA BALLE cannot be held responsible for damages of any kind, whether material or immaterial or physical, which could result from a malfunction or misuse of the products marketed. It is the same for the possible modifications of the products resulting from the manufacturers. The responsibility of C MA BALLE will be, in any case, limited to the amount of the order and could not be called into question for simple errors or omissions which could have remained in spite of all the precautions taken in the presentation of the products In the event of difficulties in the application of the present contract, the purchaser has the possibility, before any action in justice, to seek a friendly solution in particular with the assistance: of a professional association of the branch, an association of consumers or any other council of its choice. It is reminded that the search for an amicable solution does not interrupt the "short period" of the legal guarantee, nor the duration of the contractual guarantee. It is recalled that as a general rule and subject to the appreciation of the Courts, compliance with the provisions of this contract relating to the contractual guarantee assumes that the buyer honours his financial commitments to the seller. Complaints or disputes will always be received with attentive benevolence, good faith always being presumed in those who take the trouble to explain their situations. In the event of a dispute, the customer shall first contact the company to obtain an amicable solution. Failing this, the Commercial Court of Nanterre has sole jurisdiction, regardless of the place of delivery and the method of payment accepted.
Guarantee
In any case, the customer benefits from the legal guarantee of eviction and hidden defects (Art.1625 and following of the Civil Code). On the condition that the buyer proves the hidden defect, the seller must legally repair all the consequences (art.1641 and following of the Civil Code); if the buyer goes to court, he must do so within a "short period" from the discovery of the hidden defect (art.1648 of the Civil Code).
